These Terms and Conditions govern, directly or indirectly (through Users), the use of all the online products / devices / applications and services related to both the purchase of the MindMi™ system equipment, as well as to the provision of data collection and processing services, and delivery of the information which make up the MindMi™ psychological reports.

This Website is designed to offer customers the possibility to:

  1. Purchase hardware components for the MindMi™ system, namely all the elements and parts that form the equipment: the MindSpring™ hand scanner, which uses proprietary software to collect, verify and process data and then share it to the web-based MindDeck™ application to be further processed and used to generate psychological analysis reports.
  2. Access and use the MindDeck™ web-based application in order to process the data collected with the MindSpring™ hand scanner and generate the MindMi™ reports.

The MindMi™ system consists of three distinctive components:

  1. MindSpring™ – the hardware component used to scan the examinee (the “Device” or the “Scanner”) and includes the operating software.
  2. MindDeck™ – the multilingual cloud-based web application (the “Application” or the “App”).
  3. MindMi™ reports – access to the individual customized psychological reports (the “Reports”), subject to the company’s terms.

By accessing, searching and using this Website and/or by purchasing a MindSpring™ electronic scanning device, respectively by using the Device and the MindDeck™ Application to determine the psychological indicators relevant for the analysis, carried out according to our instructions for use, you hereby acknowledge that you have read, understood and therefore agree to all the terms and conditions provided below (including the confidentiality clause) and to the General Terms of Use.

These pages, their content and infrastructure, the MindDeck™ App and the MindMi™ Reports on the pertinent psychological indicators rendered through the Application and this Website (the “Service”) are the property of Psychometric Systems S.A., operated and provided by Psychometric Systems S.A. on an exclusive basis (“Us”, “We”, “Our” or “Ours”) and are made available solely for your personal, non-commercial use, subject to the terms and conditions set forth below.

The seller of the Device, owner and operator of the Application is PSYCHOMETRIC SYSTEMS S.A., a legal entity incorporated under Romanian law, having its registered office located in Cluj-Napoca, at 16, B-dul Muncii, Cluj County, Romania, formed with the Cluj Trade Register under no. J12/2335/04.08.2014, tax registration no. RO33448575.

Definitions:

  1. Customer/User:any person, whether private individual or legal entity, that accesses or uses the Website and/or places orders, inputs the data collected by the Device into the Application or otherwise interacts with the Website’s Application and/or the related websites or services/applications.
  2. “Owner/Seller”: Psychometric Systems, a legal entity incorporated under Romanian law, having its registered office located in Cluj-Napoca, at 16, B-dul Muncii, Cluj County, Romania, formed with the Cluj Trade Register under no. J12/2335/04.08.2014, tax registration no. RO33448575.
  3. Product/Products: the MindSpring™ Scanner (which also includes the required operating software), as well as any and all other products specified in the Order and which will be delivered by the Seller to the Customer.
  4. Services: the use of the web-based MindDeck™ Application in order to generate the MindMi™ Reports or to credit your personal account with points, as well as any and all other services specified in the Order and which will be delivered by the Seller to the Customer.
  5. Order: the electronic document created as a means of communications between the Seller and the Customer, which expresses the Customer’s intention to procure certain products and/or services from the Seller’s website and to pay for them.
  6. Contract: any Order accepted by the Seller in which Seller agrees to sell and deliver the Products and Services offered online on the Website and the Customer agrees to purchase, pay and receive such Products and Services.
  7. Website: the website owned by Psychometric Systems S.A., located at mindmisystem.com and which ensures the intermediation and management of online purchases and sales of the MindSpring™ Scanner, of the value points required to generate the MindMi™ Reports and of the use of the MindDeck™ Application, respectively of all related websites and services or applications, as mentioned above or logically related, belonging to the Owner.

 

General Conditions

PSYCHOMETRIC SYSTEMS S.A. shall endeavor to present, as clearly and concise as possible, the way this Website works. To view the Website’s General Terms of Use please click here. Notwithstanding the above, the Seller shall under no circumstances be legally responsible for any oversight, information deemed offensive or harmful or any incorrect description of the information presented or generated by this Website, including the data provided in the MindMi™ Reports.

The content of the MindMi™ Reports becomes the sole property of the User upon their generation in the Customer’s personal account and therefore the Seller shall assume no responsibility for the purpose or manner in which the information rendered in the MindMi™ Reports is used or disclosed by the Customer.

 

Using Our Website

The idea behind this Website is to provide the User with an innovative, quick and completely automated method of psychological evaluation through the mere scanning of your palms.

To be able to use the MindDeck™ web-based application, you have to first purchase an electronic device, our MindSpring™ Scanner, which collects data for the quick generation of a psychological profile.

The MindSpring™ scanner is a subtle, noninvasive electrical stimulator that records specific electrodermal changes in response to a particular input of frequencies. The device collects pertinent data, analyzes it and then translates it into hundreds of specific patterns corresponding to different BEHAVIORAL ASPECTS / PATTERNS OR PSYCHOLOGICAL PROFILES / TRAITS.

How to Purchase the Scanner

1. Registering as a User

You can register as a user only upon purchasing the MindSpring™ scanner, by accessing the “Shop” section on our Website. You will be redirected to the online shop page.

After accessing the “Shop” section, at least one MindSpring™ device will be added to your cart, redirecting you to the “Shopping Cart” section of the Website.

When you are ready to order, click on the “Finalize Your Order” button and you will be redirected to the user registration page. The registration form comprises all the data enabling us to identify you as a user, as well as all the elements necessary for the contractual relationship with Psychometric Systems S.A.

To create a new account, you must input a valid email address. We reserve the right to reject any application for account registration if we determine you have provided false information or don’t comply with the stated purpose and use of the Services.

After filling in the respective fields with the first and last names, as well as email address, you will be required to choose a password for the newly created account.

When supplying the invoicing and delivery information, you will be asked to specify whether you are a private individual or a legal entity. Self-employed persons are included in the ‘Legal Entity’ category.

A customer’s capacity—whether individual or legal entity—is important to determine the manner in which taxes (VAT, import duties, shipping fees) are applied to the ordered products and services. The calculation and imposition of the applicable taxes, the issuance of the supporting financial documents as well as the recording of the transactions are made automatically, based on the data you provided. To this effect, you, as User, shall bear the sole responsibility for the accuracy of the information supplied, as well as for any and all subsequent legal and tax consequences.

Under no circumstances shall We, as Seller, be liable for any false or inaccurate information you provided with respect to your capacity as individual or legal entity, nor for any damages derived from such an inadvertence.

You may place orders by accessing the “Buy” option and adding the products to your shopping cart. The next steps will guide you through the payment method, contact and shipping information.

When you are ready, click on the “Place Order” button and shortly, you will receive a confirmation email to the email address provided upon registration. Please check your Inbox and Spam folders to make sure you receive the email.

THE ORDER IS PLACED AND THE USER ACCOUNT IS CREATED ONLY AFTER YOU CONFIRM TO HAVING READ AND ACCEPTED THE TERMS AND CONDITIONS OF USE.

For existing users, the information initially input at registration is saved in their personal accounts and doesn’t require to be provided again for new orders, unless the users wish to operate a change, e.g. a new shipping address. Please keep in mind that the email address provided for registration cannot be subsequently modified.

Registered users may use the Website, the MindDeck™ Application and the Services we provide via the Website and the Application by accessing the “My account” section and logging in with their user name and chosen password.

The password protected sections of this Website are only available to registered users.

Please bear in mind that passwords should not be disclosed to third parties and should be protected from unauthorized access. In case you discover any unauthorized use of your password, notify us immediately by filling out and submitting the form available in the “Contact” section of our Website.

We shall decline any and all liability and responsibility for the losses caused by an improper handling of passwords.

Users shall be solely responsible for the actions carried out in their account and for the accurate keeping of their personal data.

Registering as a user implies your prior acceptance of these Terms and Conditions, as well as of the General Terms of Use for this Website, including the conditions of Our Privacy Policy.

2. What Happens to the Personal Data Stored?

Pursuant to Our Privacy Policy, we may disclose to third parties some of the basic details included in the registration form, but never the users’ personal identification information, unless explicitly agreed to by the user in question or if this is required in order to comply with the applicable laws and regulations in force. Furthermore, the data collected through the use of this system will be employed for statistical and research purposes, with no relation whatsoever to the identity of the examinee, save for character-related data.

3. The Order

Our Scanner may be purchased only by registered users.

Add the devices you wish to buy to your shopping cart. A “Buy” button is located next to every product. By clicking it you will add the selected product directly to your cart.

The shopping cart will be constantly updated and displayed in the menu bar, next to the Login button, on the top of the page. You can perform the following actions there:

  1. Change the quantity for every product ordered;
  2. View all the products in your cart;
  3. Delete a product from the cart (by writing “0” in the box where the desired number of pieces is or simply by clicking on the red “Delete” button).

If you add a product to your cart without actually proceeding to checkout, your order will not be recorded and your products will not be automatically reserved.

By finalizing your order, you agree that all the details supplied for the purchase are true, complete and accurate.

You will receive a confirmation email for your order after you have provided all the necessary information. The order details can be verified either in the attachment to the confirmation email or in the “Order History” section in your user account. This section of our Website is only available to registered users.

In the event you notice in the confirmation emails or otherwise that your order contains errors you are required to promptly notify us, so we can find the best solution to this matter in the shortest time possible.

After submitting your order you will receive an automated confirmation of receipt of order and payment method by email.

If you wish to pay via bank transfer, using the Direct Bank Transfer option, the required bank account number will be provided for a payment in advance.

If you select the “Credit Card Payment” option, available through a payment service provider chosen by Psychometric Systems S.A., the selected payment method will be provided.

Payment confirmation shall be deemed as the moment your Contract to purchase these products is created. This Contract becomes binding when we send the email informing you that payment has been confirmed and the products are scheduled for dispatch.

4. Dispatch and Delivery

Shipping is free of charge worldwide. However this doesn’t apply to the customs duties or other taxes that may be levied in the place of destination.

Products will usually be delivered within 7 business days in Romania and 15 business days worldwide. Please be informed that these delivery times are determined based on the estimates of our preferred carrier company and We, as Seller shall bear no responsibility whatsoever for any failure to meet the delivery deadlines.

If your order doesn’t arrive on time, please contact us to expedite the delivery process.

Despite our products being always in stock, in exceptional cases shipping may take longer than initially estimated and you will consequently receive a notification email with the new delivery times.

5. Payment

You may choose either payment method to pay for your ordered Products (Devices):

  1. Via bank transfer (payment order). Proceed to payment by wire transfer after you receive the email with your order confirmation and the corresponding bank account. Upon delivery, you will also receive a hard copy of your purchase invoice;
  2. By credit card. We accept the following cards: VISA, VISA Electron, Maestro, MasterCard etc., courtesy of our preferred payment service provider. This method of payment is completely secure. Upon payment, in order to ensure the transaction is protected, your confidential information is transmitted directly through the payment processor.

The amount corresponding to your purchase order will be deducted from your bank account. If the transaction is authorized, then the payment is processed right away and your order will be shipped according to the delivery schedule.

Please pay attention to the transaction details, as the total amount may include taxes, fees or other additional charges. It is your duty to discover all such costs.

Psychometric Systems S.A. shall not be held liable for any events of fraud or unauthorized third-party access of your credit card, as well as for other forms of cyber fraud or forgery, data and software losses, computer-related sabotage, unauthorized computer access, unsanctioned interceptions, unauthorized account cloning or cyber spying.

If you suspect an internet fraud might have occurred, we advise you to contact your issuing bank immediately.

The taxes added to the amount of the products in your cart (i.e. import duties, VAT, delivery charges) may differ according to the buyer’s capacity—whether an individual or a legal entity – and to the country of destination.

The VAT Procedure for Standard and Digital Products in the Order Flow for private individuals and legal entities – relevant regulations in force shall apply.

6. Currency

The prices corresponding to the available products and packages of points are expressed in Euro and Romanian Lei.

7. Product Warranty and Claims

The warranty is only available for the equipment and is valid for 1 (one) year.

The warranty period is calculated from the date specified on the invoice as the delivery date of the MindSpring™ Scanner to the Customer.

The Seller shall bear the liability for any and all product defects which exist upon delivery or which occur within the warranty period. Post-warranty service will be provided according to the applicable regulations in force.

Product warranty coverage refers to the following:

  1. If the product presents a defect which prevents regular use according to its stated purpose, then the Customer—private individual, not legal entity—shall be free to demand a total or partial replacement or cancel the purchase, within 22 business days from the invoice date.
  2. In case the Customer opts to have the defect repaired, the Seller is required to partially or fully replace the product, as applicable.
  3. If the defect cannot be remedied, due to its disproportionate nature, and the product cannot be replaced, the Customer will be entitled to a full refund, transferred to the bank account specified in the product return form.
  4. If the product presents several or repeated defects, the Customer has the right to demand a replacement or to cancel their purchase. Several defects mean at least 3 defects which prevent the product from being used according to its regular purpose.

The warranty is voided in the following cases:

  1. Mechanical damages or deterioration; lack or change of the Device’s serial number; change of product;
  2. Faults caused by a failure to comply with the instructions for use, transport, handling and installation set out in the user manual;
  3. Mechanical damage produced by an impact to the Device or deterioration of the marking containing the Device’s model and serial number;
  4. Flood, fire, sun exposure, electric discharges, improper modification or installation, unauthorized intervention;
  5. Destruction of internal circuitry due to shocks.

To benefit from the warranty, the Customer is required to submit a written claim for the defect found.

The claim must include a description of the defect. When the item is sent in for repair, replacement or order cancellation, the Customer will include in the package the original invoice received or a copy thereof.

Claims are processed promptly and the Customer will be kept apprised of the findings. The Seller will inform the Customer about the time and method needed to process the claim. The Customer will receive a confirmation of the necessary repairs and length of time or, depending on the case a written explanation of why their claim was denied.

8. Order Cancellation

In the meaning of Romanian Government Emergency Ordinance 34/2014 on consumers’ rights under contracts concluded with vendors, amending and supplementing certain legislation, a consumer (private individual) is entitled to notify the vendor in writing on their order cancellation, without being subject to penalties and without having to provide a reason, within 22 business days from invoicing.

In the event of an order cancellation, the consumer shall bear the direct return shipment charges.

If the consumer exercises their right of unilateral withdrawal from the Contract, the vendor is required to refund the amounts paid by the consumer, without charging any refund fees. This reimbursement shall be operated within 30 days from the date of consumer’s withdrawal.

The Seller will issue a cancellation invoice and subsequently refund any and all amounts already paid by the Customer for the purchase, provided the Device is shipped back and reaches the Seller within this time frame.

If the Customer cancels the purchase of the Scanner according to this clause, the Customer is required to return it, and subsequently bear the corresponding costs, in the same condition as when delivered (i.e. unspoiled, with all accessories and consumables, in its original packaging) no later than 14 days from the day on which the Customer notified the Seller on the intention to withdraw from the Contract.

Once finalized, the order cancellation option is not possible for the services available through the MindDeck™ Application, respectively for the points recharged to the User’s wallet or for the request of a MindMi™ Report.

9. Product Return Policy

If returned, products must be in the same state in which they were when first delivered to the Customer, in their original packaging, with the labels intact and along with all the accompanying documents (invoice, warranty certificate, user manual, etc.).

Returned products must be in the same condition in which they were received by the Customer: without defects (except for any defects already notified by the Customer).

Products will not be accepted for return if at least one of the situations below has occurred:

  1. There are unauthorized modifications made to the product;
  2. The packaging is damaged or incomplete;
  3. There are signs of wear & tear or excessive use;
  4. There are scratches, chippings, dents or mechanical / electrical shocks present;
  5. Missing accessories;

10. Using the MindDeck™ App to Determine the Psychological Profile and Generate Customized MindMi™ Reports

The MindDeck™ Application allows smooth and efficient management of registered user data, as well as the online setup and operation according to set parameters of the MindSpring™ hand scanner. All the MindMi™ App generated Reports are automatically archived in the users’ accounts and are available for printing, sharing by email or downloading on local devices. The MindDeck™ platform can be accessed with and is optimized for Chrome, Firefox and Safari.

By initializing the MindSpring™ Scanner, the User can register pursuant to the user registration procedure described herein.

Subject examination procedure is detailed on the left side of the user page.

The examiner will assist every examinee during the scanning process by correctly positioning the latter’s hands on the MindSpring™ Device for approximately 5 minutes. The data collected by the Scanner is immediately synchronized to the MindDeck™ App.

MindDeck™ may be used to purchase point packages, to generate one of the available MindMi™ Reports and for the entire procedure relating to the use of the Device.

Once the data collected by the Device are uploaded, the User can generate one of the specific psychological reports with the help of the MindDeck™ Application and based on various psychological indicators of interest.

All the data and the already generated Reports are saved and stored with the Application in the cloud and they remain accessible to the User in their account for any potential future use. Saved data is available online 24/7.

The process is completely unbiased since there is no person involved who could influence the result in one way or another.

11. Service Provision via MindDeck™

The way our MindDeck™ App works is easy to understand with the help of the tutorials available online.

Device owners can access the Application both to add points to their account, as well as to retrieve one of the available MindMi™ Reports.

The price of the MindMi™ Report generation service is expressed in points.

Every registered user can check the number of available points in the “My account” section of the Website. In order to generate a Report with MindDeck™, the User has to have enough points in their online wallet as is required to obtain the requested MindMi™ Report.

Every such psychological Report costs a certain amount of points, as indicated next to it. The points are deducted from the User’s account every time a specific MindMi™ Report is generated.

Upon purchasing the Device, every User is awarded a bonus package of 600 points, which may be used to generate Reports.

Once spent, Users may purchase additional points by accessing the “Buy” section in the accounts.

It is prohibited to use the Services in an illegal or unsuitable manner or contrary to their stated purpose. Users may use the services rendered through the MindDeck™ Application solely according to the legal provisions in force in the country in which they are used, as well as according to the Romanian laws, including to the applicable export and re-export regulations. In the event of Users breach these Terms and Conditions or the applicable legislation, Psychometric Systems S.A. retains the right to suspend or terminate the provision of these Services to such Users.

12. How to Recharge Your Online Wallet

As a registered user, you can check the number of available points in your MindDeck™ App or in the “My account” section of the Website.

We have created six different package options to meet the various needs of our Customers. The description of every such package is displayed next to it, specifying their specific purpose. The procedure to credit user accounts with points depends on the package option chosen by the users.

To recharge your wallet, access the “Add points” section in the MindDeck™ App.

After logging in with your user name and password, you can acquire points by clicking on the “Add points” button and adding the selected package to your shopping cart.

Every package you wish to purchase must be added to the cart. The “Add points” button displayed next to the packages will add the selected package to your shopping cart.

The shopping cart will be constantly updated and displayed in the menu bar, next to the Login button on the top of the page. You can perform the following actions there:

  1. Change the quantity for every product ordered;
  2. View all the products in your cart;
  3. Delete a product from the cart (by writing “0” in the box where the desired number of pieces is or simply by clicking on the red “Delete” button).

When you are ready to pay, click on “Finalize Order” and this will prompt the “Order” window to appear. You will be required to log into your account in order to make the purchase.

You may choose either payment method to pay for your ordered products (devices):

  1. Via bank transfer (payment order). Proceed to paying in advance by wire transfer after you receive the email with your order confirmation and the corresponding bank account.
  2. By credit card. We accept the following cards: VISA, VISA Electron, Maestro, MasterCard etc., courtesy of our preferred payment service provider.

Upon payment, in order to ensure the transaction is secure, your confidential information is transmitted directly through the payment processor.

The ordering process will be completed when you click on the “Place Order” button displayed in the confirmation window.

The provisions of the “Currency” and “Payment” sections of these Terms and Conditions shall apply accordingly.

PLACING THE ORDER AND IMPLICITLY ENABLING THE USER CREATION PROCESS WILL BE CARRIED OUT SOLELY AFTER YOU CONFIRM READING AND AGREEING TO THE TERMS AND CONDITIONS OF USE, WHICH CERTIFIES THAT YOU UNDERTAKE TO COMPLY WITH ALL THE GENERAL OR SPECIFIC REGULATORY CONDITIONS OF PSYCHOMETRIC SYSTEMS S.A.

After finalizing the order you will receive an order confirmation email.

You cannot cancel your order once you have clicked on the “Place Order” button, displayed in the confirmation window which is generated after completing the payment process.

In the event you notice, in the confirmation emails or otherwise, that your purchase order contains errors, you are required to promptly notify us, so we can find the best solution to this matter in the shortest time possible.

13. The MindMi™ Reports

Every examinee whose indicators were collected through the MindSpring™ hand scanner will be saved in the “Examinees” section. Their profile will include the first and last names, as well as basic relevant data such as: age, date of birth, sex and country of residence. For every examined subject, the “Details” section of the Website provides specific information regarding the results obtained—arranged according to the type of reports generated—the number of points spent for every issued report and the reports’ respective issue dates.

A new profile, specifying the first and last names, can be created for every new examinee by clicking on the “Add examinees” button, located on the Application’s left menu bar.

For every profile created following an examination, the User can generate one or several of the available MindMi™ evaluation reports. The type and specifics of every such report are described in the “Reports” section on our Website.

The Reports are available in five languages, depending on the User’s option: Romanian, English, French, German and Spanish.

When a Report is issued, the number of points displayed next to it will be deducted from the User’s account.

Psychometric Systems S.A. is not liable for the content, quality or nature of the information or descriptions provided in the MindMi™ Reports.

Psychometric Systems S.A. is not liable for the manner in which Users understand to use the Device for scanning purposes or the generated MindMi™ Reports and the information contained therein.

Furthermore, Psychometric Systems S.A. is not liable for any possible losses, directly or indirectly, incurred by the Users or any third parties (employees, collaborators) due to the MindMi™ Reports and the information contained therein.

14. About the Software Necessary for the Services

You don’t have to install a specific software program to access the MindDeck™ Application. All you need is an Internet connection and a compatible browser, such as Firefox, Chrome or Safari. The Application is synchronized to the MindSpring™ Scanner and will be automatically initialized on the device on which you use the scanner.

By purchasing a MindSpring™ electronic scanner, We, as the Seller, grant you a personal, worldwide, royalty-free, non-transferable and non-exclusive license to use the software provided as part of the Services.

The sole purpose of this license is to allow you to use and enjoy the benefit of the Scanner and Services as provided by us, in the manner permitted by these Terms and Conditions of Use.

You may not copy, modify, distribute, sell or lease the Scanner, the Software supplied with the delivery or any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of the software that comes with the purchase of the Scanner or the use of the Services.

15 Intellectual Property Rights. Trademarks and Copyrights

The entire content of this Website, namely the text, images, graphics, sound recordings, animations and video recordings, including company logos and marks, as well as the structure of our internet pages shall be protected under the trademark and copyright laws, as well as under any other intellectual property regulations.

It is prohibited to distribute, modify or copy the content of these pages, as well as to frame or employ any framing techniques.

The MindMi™ System logo and all the names of the products, web applications and/or graphic representations of products and methods contained herein are registered marks of Psychometric Systems S.A.

Any misuse or unauthorized use of these trademarks is strictly prohibited and shall be construed as a breach of the trademark law, the copyright law and of various other intellectual property rights and unfair competition laws.

No use of the intellectual property contained on the Website or of the method to determine a psychological profile, including of the trademarks and copyrights therein, confers or assigns to you any of our intellectual property or other rights to our method or product.

You may not copy, distribute, reproduce, transmit or use in any way whatsoever the protected intellectual property of Psychometric Systems S.A. without our written consent.

Furthermore, it is strictly prohibited to copy, distribute, modify or disclose to third parties the MindMi™ method.

By purchasing the MindSpring™ hand scanner, we grant you a personal, worldwide, royalty-free, non-transferable and non-exclusive license to use the software provided as part of the Services. Unless otherwise expressly stipulated, any other software which we require to render our Services or which is available and used on our Website is the property of Psychometric Systems S.A.

16. Privacy Policy

The Content of Your Data in Our Services

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload, submit, store in the Application or receive content to or through our Services, you give us the right to use, host, store, reproduce, modify, create derivative works (such as those resulting from adaptations), communicate and distribute such content.

By using the MindDeck™ Application you agree to have the information you provide to us (including in relation to using the MindSpring™ Device or the content of the MindMi™ Reports) securely saved and stored in your user account via the Application, for any possible future use. The saved data is available online 24/7.

Personal Data

When you register as a user we will ask you to provide certain personal information, such as your first and last names, telephone or fax number, address, email address, personal number or tax registration number, as applicable, etc. We require this data to identify you as a user of our Services.

This information will be mainly needed to:

  • Create a user account and enable access to any potential facilities that may be available to registered users;
  • Charge your wallet with points in order to use the MindDeck™ App;
  • Use the MindDeck™ App;
  • Send MindMi™ Reports;
  • Handle claims or complaints regarding the delivered products / services.

Usage of Personal Information

When you willingly share your personal information with us, we warrant using this data only in the manner permitted by the law. Psychometric Systems S.A. undertakes not to provide or sell your personal information to a third party, to be used for the benefit of such party, unless expressly agreed to by you.

Psychometric Systems S.A. is registered as a data controller under no. 36394.

By registering as a user with www.mindmisystem.com/en/ you expressly allow us to store and process your personal data and later possibly use it for information purposes.

The rights of all registered users are guaranteed under the provisions of Romanian Law 677/2001 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

The User will write a request, date and sign it and mail it to the contact address specified on the Website. Thereupon, the User may be granted the following:

    1. The right of access to data: every data subject shall be entitled to obtain from the data controller, upon request and free of charge, once a year, a notice of confirmation from the latter as to whether they are or not in charge of processing the individual’s personal data;
    2. The right of intervention upon the data: every data subject has the right to obtain from the data controller, upon request and free of charge:
      1. As the case may be, the rectification, update, blocking or erasure of any data which were not processed according to the law, notably of any incomplete or inaccurate data;
      2. As the case may be, the conversion into anonymous data of any data which were not processed according to the law;
      3. A notification to a third party, to whom the data were disclosed, with respect to the operations performed, unless such notification proves to be impossible or involves an effort which is disproportionate to the legitimate interest that might be harmed;
    3. The right to object: at any given moment and based on justified and legitimate reasons, which are specifically related to his/her own person, the data subject shall be entitled to object to having his/her personal data processed, except for cases where there are legal provisions to the contrary.

Psychometric Systems S.A. is required by law to reveal the measures taken as well as, if applicable, the name of the third party to whom a data subject’s personal data were disclosed, within 15 days from receipt of any request to that effect.

Disclaimers

Psychometric Systems S.A. shall not and cannot be held liable for the damages derived from the use, in any manner, of the Products purchased or Services rendered through this Website.

While the Seller endeavors to present as accurately as possible the products it sells (using elements such as pictures, technical features and price), as well as the nature and specificity of the services it provides, nevertheless Seller does not give any warranty or make any representation that their description or any other content included in this Website is complete, or accurate or up to date.

Furthermore, Psychometric Systems S.A. shall not bear the responsibility for any potential matters pertaining to a compatibility issue between the devices or the software purchased or made available through this Website and the devices already owned or purchased elsewhere by the Customer.

The Customer hereby expressly acknowledges he/she understands and agrees to the following:

  1. Use of this Service is at the Customer’s own responsibility. The Service is provided using the principle of data objectivity, without the involvement of the human factor in the interpretation of the results of the MindMi™ psychological Reports.
  2. Psychometric Systems S.A. shall not be held accountable for any and all potential material losses, damages to the image or moral injuries caused to the person whose data were interpreted through the information collected by the MindSpring™ Scanner and the use of the MindDeck™ Application.
  3. Psychometric Systems S.A. shall not be liable for any direct or indirect losses incurred by the Customer from or in connection to the use of the MindSpring™ Scanner or MindDeck™ Application.
  4. Psychometric Systems S.A. shall not be responsible for lost profits, revenues or data, financial losses or for any indirect, special, consequential, exemplary or punitive damages however arising from the use of the Device or Services. Under no circumstances shall Psychometric Systems S.A. be liable for any losses or damages which cannot be reasonably foreseen.
  5. Psychometric Systems S.A. makes no warranties that the Services provided meet all Customer requirements / expectations.

User’s Rights and Obligations

You, as the User, understand and agree to any and all of the general and special terms and conditions set out herein and undertake to keep the confidentiality of all access information to the Services. You further agree you are solely liable for any and all potential consequences arising from the disclosure of said access information to third parties, regardless whether such disclosure was intentional, negligent or injudicious.

You shall use the “My Account” Service in compliance with these Terms and Conditions.

You may not use and/or allow a third party to use the services provided via the MindDeck™ Application for immoral or illegal purposes.

You should not disclose your user name and password to third parties and before leaving the work station (computer) you should log out of your MindDeck™ account.

You understand there are no warranties that the user name you request during the account registration process is available or allowed for use.

You represent and warrant you are the legitimate user of all the Services rendered through the MindDeck™ App and you are legally authorized to use the data provided during the report generation process without infringing in any way upon the rights or property of another person.

Any and all Third-Party Services that are offered or accessed through the use of this Website shall be governed exclusively by the terms and conditions of such Third-Party Services. Psychometric Systems S.A. is a third party in respect to any such relationship and therefore shall have no liability whatsoever with regard to the matters arising therefrom.

You can access the Services available through the MindDeckTM Application 24 hours a day, 7 days a week, 365 days a year, except when access is restricted or suspended due to technical reasons.

The right and obligations of the parties, as well as any and all legal effects derived from the use of this Website shall be interpreted and governed in accordance with the Romanian law in force.
